Abstract

The right to safe abortion in India under the Medical Termination of Pregnancy Act, 1971 is denied to pregnant women who practise consensual sex and conceive out of wedlock. This paper seeks to establish that the use of the word 'married' in the provision setting out the scope of the Act is invidiously discriminatory, redundant and, in fact, harmful to women's health, in today's Indian scenario.
