Abstract

In what have come to be known as wrongful birth or wrongful conception actions, individuals who have become pregnant after sterilization procedures have failed, have sued their doctors in negligence. In this paper, I will take the contrary view, arguing that the court's behavior can be explained using economic reasoning.
