Abstract

Abstract Romania became a Member State of the Council of Europe (CoE) in 1993. While Romania has had a democratic tradition, it also has a recent communist past. This chapter is dedicated to exploring the impact of the pan-European general principles of good administration on the Romanian legal system. It highlights that these principles play a seminal role in filling the gaps in Romanian legislation as well as in the case law. At the same time the Romanian administration is less willing to use them and relies mostly on domestic (written) law. Hence, the chapter argues that the pan-European general principles of good administration are still undergoing a process of structuring, awareness, and acceptance in Romania.
