Abstract

Iran’s legislation and regulations are derived from Shiite jurisprudence. In general sense, in addition to couples, all affinal relatives and self-relatives are included in the concept of family. In specific sense, family includes couples and children. Ultimately, in strict sense, family includes couples. In this study, which is a library descriptive research as well as descriptive qualitative analysis one, the meaning of family, consistent with writers of family law, is its strict sense. Every human being is justified to have rights, unless the legislator has enacted an exception to that desert. As family is formed and the human is considered as a husband or wife, special rights, both financial and non-financial will be conceived for him/her. The aim of this study was to examine the possibility of transferring the couples’ claims in Iran’s law. Keywords: Possibility of Transferring, Claims Transferring, Husband, Wife, Marriage.
