A Study on the Original Improvement Plan of Amnesty System

Abstract

정치적인 형사사법적 공공재로서의 사면권은 대통령의 헌법상 권한으로 정치성을 그 속성으로 한다. 그러나 이때의 정치성은 공익추구적 성격에 한정되어야 한다. 한국에서의 사면권은 범죄인이 교정(교화)가 되지 않았음에도 사익추구적 사면으로 남용되었고 그 과정에서 상징폭력을 통한 변칙사면이 난무했다. 따라서 이러한 사면제의 문제점을 개선하기 위하여 사면의 개선에 관한 많은 연구들이 있었으며 이런 연구들은 법적측면에서 상당한 기여를 하였으나 동시에 사면을 법적 접근에서만 파악한 한계가 있었다. 사면을 학제적으로 접근한 논문은 거의 없었다. 따라서 선행연구와 달리 교정복지학, 사회복지학, 정치학, 언론학, 사회학, 심리학을 포함하는 사면론의 학제적 성격에 부합하여 사면의 문제점을 거시적 측면에서 접근했다. 그리하여 우리나라의 사면에 내재된 사면의 사물화, 사면의 엘리트화, 사면의 상품화와 자본화, 사면의 가족주의화와 군사주의화를 학제적 측면에서 밝혀 사면에 은밀히 내재되어 온 사면의 상징폭력성을 해체하였으며 교정복지 측면 등에서의 사면의 새로운 개선방안을 독창적으로 제시하였다.Amnesty system as political judicial public service has been the president’s political right under the constitution. political attribute of amnesty system has been essential. But political attribute of it must be limited to cases where amnesty right seeks public interest. But president’s amnesty right in Korea has been overused by pursuit of private interests through abnormal amnesty right including general pardon and special pardon behind closed symbolic violence wrapped in public interest. Therefore, There were many studies of it to improve problems of amnesty system in Korea. They has contributed much to appropriate improvement of amnesty system in legal aspect. But they had basic limits on account of legal approach to improve problems of it. Little has given to the interdisciplinary approach to study problems of it. Thus, I approached in the interdisciplinary, macro direction including correction study, social welfare study, political study, media study, social study, psychology study to improve problems of Korean amnesty system. Therefore, I showed its private objectification, its elitism, its capitalization, its commodification, its familism, its militarism in Korean amnesty system through the interdisciplinary approach. I showed in my own way symbolic violence of Korean amnesty system hidden behind closed doors. In conclusion, I showed my original improvement plan of amnesty system. contrary to existing theories about it.
