Abstract

Professor Constance Backhouse compiles selected statutes to summarize the development of sexual assault law over the past century. She notes that changes to the language, definitions and punishments surrounding rape/sexual assault over the past century reflect changes in attitudes toward women, women's rights, and patriarchal values. The evolution of sexual assault offenses shows a shift in emphasis from the sexual nature of the crime to the violence of sexual assault, and different formulations of how consent factors into sexual crimes.
