Abstract

The EU telecom regulation relies on a market-oriented approach. In order to regulate a telecom undertaking national regulatory authorities must first define a relevant market where that undertaking is active, and then can only impose regulatory obligations upon undertakings with significant market power. For harmonisation, the European Commission is required to adopt a market recommendation and to have it periodically reviewed. So far two successive recommendations have been adopted, and it is now more or less the time to have the third one. This article aims to provide some thoughts on the third market recommendation based on a review of the relevant markets defined by national regulatory authorities in 2008-2012 when the second market recommendation was effective.
