Abstract

The author discusses publicity starting from the statics and dynamics of rights and the conflict between the assurance of preserving these rights and the assurance of acquiring them. In juridical and private matters it is acknowledged that publicity is concerned with the fundamental need that certain juridical actions and business transactions among parts are to be known by the community or that, at least, the means are facilitated for that purpose so that publicity has a legitimizing role. The author asks if registrar publicity is not mere fiction. As basis for individual property rights and, consequently, for real estate registers there is an important question related to the relation between individual rights and the collective good. The structure of patrimonial publicity and its importance in several registrar systems over the world are also discussed.
