A Propos Du Contrïle Du Pouvoir Discrtionnaire Par Les Tribunaux Administratifs Des Organisations Internationales

Abstract

This chapter presents proceedings of a Conference on international administrative law held in Paris on May 16, 2000. The occasion of the Conference was the celebration of the twentieth anniversary of the World Bank Administrative Tribunal. The idea of an international administrative tribunal was first introduced in 1927 at the initiative of the first Director of the International Labour Office. Over the years, the existing administrative tribunals saw their authority recognized by a growing number of international organizations, and other administrative tribunals were created and developed. It was sometimes felt in the beginning that since the authority of the International Labour Organization's Administrative Tribunal (ILOAT) was a strictly defined one, the Tribunal had no right to review the discretionary power of an administration. Control by international administrative tribunals over the discretionary powers of administrations is nowadays generally accepted.Keywords:discretionary power; international administrative tribunal
