Abstract
in early 2008, the draft Common Frame of Reference (dCFR) was published under the heading “Principles, Definitions and Model Rules of European Private Law”.1 This first edition of the DCFR, which takes the form of an “interim outline edition” is a milestone in the process of the Europeanisation of private law, and it will hopefully be the initial spark for a far-reaching and thorough debate among legal practitioners, stakeholders, academics, and representatives in member states’ ministries and from the EU institutions. First reactions to the DCFR are already on the table, in particular the report of the Justice and Home Affairs (JHA) Council of 18 April 2008.
