Abstract

The case against the judges is a mean of increasing the harm caused by the unfair decisions of the judges, because they are human beings who may make mistakes in their rulings, and are in breach of their rulings. And because the judiciary is a refuge for justice, and the shield that protects the country from chaos and corruption, came the verdicts of judges challenging specific cases in which civil liability can be instituted against the judges, and this is why this study came to understand the concept of litigation, And the reasons for bringing the case against the judges, and the cases that require it; deliberate and unintentional, and the implications thereof. The study concluded that judges in Islamic jurisprudence may be challenged by the Holy Koran, Sunnah and consensus, as well as by the judges, as in the Jordanian Code of Criminal Procedure, the Judicial Accountability Act and the Judicial Inspection Directorate Law. Judges cannot be contested before the credibility of the complaint is confirmed. The plaintiff shall establish evidence attesting to the validity of his case.
