Abstract

This paper analyzes how the principle of democratic management, established in the Federal Constitution of 1988 and in the National Education Guidelines and Framework Law no. 9.394/1996, is included in the Laws of creation of the Municipal Councils of Education –(called CME) from Barreirinhas, Codó and Icatu, municipalities of the State of Maranhão, Brazil. For the development of this paper, we used bibliographical, documentary research and data related to the research done by the National Union of Municipal Councils of Education (called UNCME), in 2015, on the institutionalization and functioning of CME in Maranhão. We found that the laws of the CME of the municipalities surveyed do not explicitly bring the principle of democratic management into practice. The absence of such a principle, as part of the management of the Municipal Education System, can hamper the strengthening of spaces of participation, construction of autonomy, decentralization of local power and exercise of citizenship within the municipality.   Keywords: Democratic Management.
