Abstract
O artigo tem como objetivo principal analisar alguns dos textos legislativos que incentivaram a expansão do ensino superior privado com fins lucrativos no Brasil, desde a Constituição Federal de 1988, até meados dos anos de 2010. A análise textual foi feita por meio da abordagem qualitativa, com a seleção de livros, teses acadêmicas, artigos publicados em periódicos, a legislação pertinente à discussão, e alguns dados estatísticos. Dessa forma, foi possível observar o destacado crescimento das Instituições de Ensino Superior Privadas Lucrativas, num curto espaço de tempo, sobretudo por meio do forte papel do Estado e do Fundo Público.
