Abstract
Diante das teses substancialista e procedimentalista e seus diversos pontos de fricção quanto a interpretação, propõe este trabalho que a perspectiva de solução se enquadra na perfeita fundamentação vinculando o julgador ao caso e, neste ponto, o novo código de processo civil aparentemente trouxe a lume uma fórmula adequada a ser aplicada pelo Tribunal Constitucional brasileiro.
