Abstract

This article analyzes the persistence adopted by the Judiciary for the continuity of labor hearings during the covid-19 pandemic, which caused many changes in the legal system and which were adopted in Labor Law. After the discovery of the pandemic that seriously affected the world, including Brazil, all sectors (primary, secondary and tertiary) were affected. With regard to the primary sector (government), it had to adopt preventive measures for the health of the population, such as the use of individual protection masks, distancing between people, staying at home, in what became known as “stay at home”, among other measures. preventive. In addition to these measures, it is worth mentioning that the Judiciary, belonging to the first sector, likewise had to adopt preventive measures in order to continue with the procedural procedures to assist the jurisdiction that needs a final answer to its dispute. This was the case in the labor sector, with the emergence of videoconference hearings, which were extremely important for the continuity of the labor procedural progress. This modality of hearing by videoconference was already being adopted only in the Federal Court and after the pandemic outbreak it was adopted in the Common Court and in the Labor Court, which remain until the present day. It is of the utmost importance that the measures adopted during the pandemic period continue, as the inclusion of these measures contributed greatly to the final objective of the jurisdiction, which is the magistrate's response through a court decision, regardless of whether it is valid or unfounded, the important is the continuous progress of the labor process. It should be noted, therefore, that the measures adopted had only a positive contribution in the Judiciary, although at the beginning of their adoption they suffered some reprisals from lawyers who defended the non-use of the hearing by videoconference in labor hearings of instruction and judgment.
