Abstract

The study conducted a comparative analysis of the Plea Bargain, between the Brazilian and Italian legal systems, with emphasis on the investigation of crimes committed by criminal organizations, specifying the normative forecasts and the hypotheses of the agreement. We observed relevant points of convergence between the researched systems, notably the validity of the accusatory system and the principle of mandatory criminal action. In Italy, repentance was widely used in the fight against terrorism and mafia-type criminal organizations, while in Brazi, its use was disseminated in relation to white-collar crimes,especially corruption and money laundering.
