Abstract

The procedure of notification and consultation in good faith is another important element of procedural mechanisms of transboundary water management. This chapter mainly focuses on prior consultation regarding planned activities, since the issue of regular consultation seems too general to be discussed as a unique procedural mechanism and public consultation is dealt. In addition, consultation can be used as a part of the non-compliance mechanism. The chapter is separated into two sections: one is about prior notification and consultation on planned activities and another is with regard to emergency notification and cooperation in its response. Discussions begin by exploring the rationale of each mechanism, followed by analysis on important international documents. Specific attention is then paid to the Mekong region, focusing on the existing notification and consultation arrangements among the lower Mekong countries and the prospects of relevant development between China and other Mekong countries.Keywords: China; consultation arrangements; emergency notification; good faith; international documents; lower Mekong countries; transboundary water management; unique procedural mechanism
