Abstract

A recurring practical question when initiating an investor-State dispute settlement proceeding is whether to choose ad hoc arbitration or institutional arbitration, provided that such a choice exists. Ad hoc arbitrations are frequently administered by an institution or require the services of an institution for specific procedural steps, such as the appointment of arbitrators. The aim of this contribution is to explain the role of a secretariat in the administration of an international investment dispute, which implies an overview of the dispute settlement process, and, allow the users to make an informed decision in this regard. This Chapter focuses primarily on the role of the ICSID Secretariat in the administration of international investor-State disputes, and is meant to help clarify the Investment Disputes between States and Nationals of Other States (ICSID) Secretariat's role in the administration of cases.
