Abstract

For the legal status of seafarers, he/she must have 14 days of self-quarantine mandatorily due to COVID-19 in various aspects such as repatriation, paid leave, and reserve personnel what to clarify the legal nature of the compensation; An amount equivalent to 70% of the regular wage or 100,000 won per day, which is paid by agreement between the seafarer and the shipowner. In addition, regarding the condition of reality that the seafarers are classified as overseas entrants and excluded from various government’s supports for living, the problems of the regulation on exclusion of support for entrants from oversea. Moreover, discussed whether it is appropriate for the repatriated seafarers to be classified just as overseas entrants considering the seafarers' work attributes. This study suggested that, at least, it is necessary to legislate in detail in the Seafarers Act is needed to prevent them not to fall short of general workers do in the same case. Even though it is impossible to assume the legal status of seafarers in all cases, including in special circumstances such as COVID-19.
