Abstract
Since the moment that the United Nations Commission on Human Rights (Commission)the parent body of the UN human rights special procedures systemwas replaced by the UN Human Rights Council (Council), the question became: What effect if any will this change have on special procedures? To consider this issue, this chapter first recalls the origin and development of special procedures under the Commission and then to point out their main strengths and weaknesses. It then discusses why UN Member States decided to replace the Commission with the Council and how this change could affect special procedures. Unlike the Commission, which was a functional commission of economic and social council (ECOSOC), the Council has been constituted as a subsidiary body under the General Assembly and as such it operates directly under the Assemblys auspices, commanding higher institutional profile within the UN system than did the Commission.
