Abstract

In October 2012, the European Court of Justice (ECJ) published orders of 15 June 2012 rejecting the appeals of Otis and United Technologies Corporation (UTC) against an earlier EU General Court (GC) ruling in the lift and escalator cartel case. In February 2007, the European Commission had imposed record fines on members of a cartel in the lifts and escalators market. The Commission fined the KONE, Otis, Schindler, and ThyssenKrupp groups a total of €992 million for operating cartels for the installation and maintenance of lifts and escalators in Belgium, Germany, Luxembourg, and the Netherlands in violation of Article 101 TFEU (see VBB on Competition Law, Vol. 2007, No. 3).
