Abstract

This chapter provides a comprehensive coverage of energy law and emerging legal issues. Part one introduces and defines the topic of energy law. Part two summarizes the relevant trends and developments in international energy law. In particular, it covers the laws surrounding the oil and gas industry, and renewable energy laws, such as those contained under the Statute of the International Renewable Energy Agency (IRENA) and those adopted by the European Union (EU). Part three then shifts focus to the national energy laws that govern in the United States, looking into the legal developments in the electric power and transportation sectors, the Clean Power Plan, hydropower and competing water uses, legal authority over new hydrokinetic projects, federal and state powers over electricity transmission line siting, standing to challenge regulatory agency decisions concerning greenhouse gas (GHG) emissions and global warming, federal and state laws and incentives for alternative fuels, and hydrogen fuel deployment and permits. Part four offers insight into the future direction of international energy law and the national energy laws of the United States. Lastly, Part five brings the chapter to an end with concluding remarks.
