Abstract

This chapter examines three potential legal frameworks effectively used by other progressive social justice movements that may be adopted by intersex activists to advance their goals: human rights, disability rights, and sex discrimination. In particular, it considers the legal arguments developed by other social justice movements and whether the intersex movement could benefit by employing similar approaches. The chapter begins with an overview of lawsuits involving people with an intersex condition, such as those that challenge genital cosmetic surgery and other medical practices, discriminatory actions, and government policies concerning people with an intersex condition. It then discusses theoretical approaches supporting legal reform to protect people with an intersex condition from discriminatory practices.
