Abstract

This chapter discusses building contracts in Scotland. The Standard Form of Building Contract published by the Joint Contracts Tribunal (JCT) has, as amended by the Scottish supplement, been the accepted set of contract conditions for building contracts in Scotland. The Scottish supplement to the Standard Form is published by the Scottish Building Contract Committee (SBCC), which was set up in 1964, and with, initially, similar representation to that of the JCT; subsequently, the Association of Scottish Chambers of Commerce and the Confederation of British Industry joined. The 1963 edition of the Standard Form was the first edition for which a Scottish supplement was published and a revision was issued almost every year by the SBCC to match the revisions issued by the JCT until the publication of the 1980 edition of the Standard Form by the JCT. This edition contained a number of important amendments as compared with the 1963 edition, but the major change related to the procedure for nomination of a sub-contractor and the publication by the Tribunal of a Standard Form of Sub-contract for a Nominated Sub-contractor.
