Abstract

This chapter describes women litigants’ experiences in family court and the ways in which power and control during the marriage are perpetuated in the legal arena during divorce and custody disputes. It uses research based on the voices of diverse women engaged in divorce and custody disputes to highlight the power and control tactics frequently used in family court proceedings by abusive ex-partners. Gender bias in courtroom procedures and judicial decision making about child support, custody, and visitation is discussed. This chapter also examines how mental health professionals may assume a key role in promoting the use of gender- and culturally sensitive practices to advance social justice in family court.
