Abstract

This paper discusses a method for evaluating degrees of inventive step of inventions by applying to the AHP (Analytic Hierarchy Process). In spite that judgment on inventive step has been long studied and discussed, since criteria regarding the judgment on inventive step are varied and vague, a qualitative judging method has merely been suggested and a judgment result merely has been concluded whether an invention meets the patent level or not. We focus on that the judgment on inventive step is resulted from some kind of examiner's decision with his own sense and try to evaluate degrees of inventive step by applying to the ARP which is useful for the decision under vague circumstances in order to contribute to the technical evaluation or the patent value evaluation as well as patent judgment.
