村务公开中村民的法律地位探讨 The Discussion about the Legal Status of the Villagers in Open Village Affairs

Abstract

村民参与村务公开是基层民主监督的重要途径，也是村民自治的重要环节。村民主体地位的确立是实施村务公开的关键，只有激活村民的民主意识，突出村民的主体地位，畅通村民的意愿诉求渠道，才能加快农村民主进程的建设步伐。对村民的主体地位进行法律建构，加强村民在村务公开中的主体地位，不仅有利于村民参与村务公开，而且能够切实保障村民的知情权、参与权、监督权。 Villagers’ participation in open village affairs is an important way to promote the democracy supervision at the grassroots level, and also the important link of the villagers’ autonomy. The establishment of villagers’ subject status is the key to the implementation of open village affairs. Only by activating the villagers’ democratic consciousness, highlighting villagers’ subject status, and expediting villagers’ appealing channel, can the construction process of rural democracy be sped up. Conducting the legislative construction of villagers’ subject status and enhancing villagers’ dominant roles in open village affairs not only benefit the villagers’ participation in open village affairs, but also guarantee villagers’ rights to know, to participate, and to supervise.
