มาตรการทางกฎหมายเพื่อส่งเสริมการสร้างป่าเอกชน: ศึกษาเปรียบเทียบกฎหมายป่าไม้ของประเทศฝรั่งเศส และประเทศไทย (Legal Measures for Promoting Private Forests: A Comparative Study of Forest Laws of France and Thailand)

Thai Abstract: มาตรา 7 วรรคหนงแหงพระราชบญญตปาไม (แกไขฉบบท 8) พ.ศ.2562 สงผลใหไมทขนในทดนกรรมสทธหรอสทธครอบครองตามประมวลกฎหมายทดนหรอไมทปลกขนในทดนทไดรบอนญาตใหทาประโยชนตามหนงสอแสดงสทธทรฐมนตรประกาศกาหนดโดยความเหนชอบของคณะรฐมนตรไมเปนไมหวงหามเพอกอใหเกดแรงจงใจแกเอกชนทจะปลกไมในทดนของตนเองในลกษณะของปาเอกชนนอกเหนอจากจากการทาสวนปาตามพระราชบญญตสวนปาพ.ศ.2535 ซงอาจเกดปญหาการตรวจสอบแหลงทมาของไมและการจดการปาอยางยงยนในพนทปาเอกชนดงนนเพอหาแนวทางในการแกไขปญหาดงกลาวจงศกษาเปรยบเทยบกบมาตรการทางกฎหมายในการจดการปาเอกชนตามกฎหมายปาไมของประเทศฝรงเศสเนองจากเปนหนงในสามของประเทศสมาชกในสหภาพยโรปทมการจดการปาเอกชนอยางเปนระบบผลการศกษาพบวาการนาการจดการปาเอกชนตามกฎหมายปาไมของประเทศฝรงเศสมาปรบใชกบกฎหมายทเกยวของกบปาเอกชนของประเทศไทยใหเกดประสทธผลไดตองประกอบดวย 1) กาหนดใหเอกชนผเปนเจาของปามหนาทบารงและจดการปาอยางยงยนภายใตแผนจดการปาเอกชน 2) กาหนดจานวนเนอทซงตองทาแผนและกาหนดใหชดเจนวากรณใดไดรบการยกเวนไมตองทาแผนจดการปาเอกชนแตยงคงอยภายใตการกากบดแลของเจาหนาทเพอควบคมและตรวจสอบแหลงทมาของไม English Abstract: Section 7 of the Forest Act (No. 8) B.E. 2562 allows the trees, which grow on lands with the right of ownership or right of possession under the Land Code, or with the permission to use in accordance with the letter of rights prescribed by the Minister with the approval of the Council of Ministers of Thailand, will not be regarded asthe reserved timber. This attempts to encourage the private sector to plant trees in their own land in the form of a private forest which is different from the forest plantation underthe Forest Plantation Act B.E. 2535. However, this may lead to problems relating to the inspection of the origin of timber and sustainable forest management in private forest areas. Therefore, in order to find solutions to solve such problems in Thailand, this research will study the legal measures for the management of private forests under French forest law in comparison with Thailand. This is because France is one of the three EU member states that has the effective systematic management of the private forest. The research proposes thatin order to apply the approach on the private forest management in the French forest law to the laws related to private forests in Thailand effectively, it is necessary to carry out the following task: 1) To require the private forest owners to have the responsibility in maintaining and managing forests in a sustainable way in accordance with the private forest management plan; and 2) To determine the amount of area which are required to make the private forest management plan and clearly indicate what circumstance should be exempted and does not require to make the private forest management plan, but this should remain under the supervision of the authorities in order to control and monitor the source of the timber.
