أحکام نقل العدوى بفیروس کورونا (COVID-19) وآثارها فی الفقه الإسلامی

Abstract

تناول هذا البحث قضية من أهم القضايا المعاصرة؛ حيث انتشر هذا المرض الفتاک انتشارا واسعا في کل بلاد العالم، ولم يتم التوصل حتى الآن إلى علاج فعال له، ولا وسيلة للحد منه ومواجهته سوى التباعد الاجتماعي، والالتزام بالإجراءات الاحترازية التي أوصت بها الهيئات والمنظمات الصحية في کل أنحاء العالم، لکن قلة الوازع الديني لدى بعض الناس جعلهم لا يلتزمون بهذه الإجراءات، وربما اتخذوا هذا الفيروس کسلاح خفي للإضرار بالمجتمع، أو الأشخاص، فجاء هذا البحث لمعالجة تلک القضية ببيان أحکام وآثار نقل العدوى؛ حيث إن معرفتها والالتزام بها قد يترتب عليه منع انتشارها أو تقليل ذلک. وقد تکون هذا البحث من مبحث تمهيدي، وفصلين، تحدثت في المبحث التمهيدي عن ماهية العدوى أولا، ثم ماهية فيروس کورونا، فقمت بتعريفه، وبيان تاريخه، وأعراضه، وسلالاته، وطرق انتقاله. وتحدثت في الفصل الأول عن صور نقل العدوى بفيروس کورونا وأحکامها، فتحدثت عن حکم اغتسال المصاب بفيروس کورونا في الماء الراکد أو الوضوء فيه، وحضوره للجمعة أو الجماعات في المسجد، وخروجه إلى العمل والأماکن العامة، والحج أو العمرة. وفي الفصل الثاني تحدثت عن نقل العدوى بفيروس کورونا من المريض إلى الصحيح في حالتي العمد، وعدمه، وذلک ببيان التکييف الفقهي لنقل العدوى في کل حالة من الحالتين، وحکم نقلها، والآثار المترتبة على ذلک، ثم ذيلت البحث بخاتمة ذکرت فيها أهم النتائج، والتوصيات. This research deals with one of the most important contemporary issues as this deadly disease has spread widely in all countries of the world and no effective treatment has yet been reached nor is there no way to reduce and confront it except for social distancing and adherence to the precautionary measures recommended by health authorities and organizations all over the world. Yet the lack of religious awareness of some people made them not abide by these measures and they may have taken this virus as a hidden weapon to harm society or people. Thus, this research came to address this issue by clarifying the provisions and effects of transmission of infections knowing and adhering to it may prevent or reduce its spread. This research consisted of an introductory study and two chapters. In the introductory study, I talked about what infection is first, then what the Coronavirus is, so I defined it and explained its history, symptoms, strains, and methods of transmission. In the first chapter, I talked about the images of transmitting infection with the Coronavirus and their provisions, so I talked about the provision on ablution for a person with Coronavirus in stagnant water or ablution in it, attending Friday prayer congregations or groups in the mosque and going out to work and public places and Hajj pilgrimage or Umrah. In the second chapter, I talked about transmitting infection with the Coronavirus from the patient to the healthy in both cases of intentional, and non-intentional by explaining the jurisprudential conditioning of transmission of infection in each case, the ruling on its transmission and the consequences of that. Then the research was appended to a conclusion in which I mentioned the most important results and recommendations
