Abstract

Permanent reformation of Art. 157 of the Criminal Code of the Russian Federation drew increased attention to the matters of criminal liability for failure to make alimony payments; such matters were resolved by the Plenum of the Supreme Court of the Russian Federation in Resolution No. 39 of December 22, 2022, On the Judicial Practice in Criminal Cases on Failure to Make Payments to Support Children or Parents Unable to Work (Art. 157 of the Criminal Code of the Russian Federation). The following provisions of the new practice-oriented act are highlighted as the most important ones: explanations of the “similar act” crime-forming attribute; timeline in the determination of the period when failure to discharge alimony obligations entails criminal prosecution; judicial interpretation of “damage compensation” and “making outstanding alimony payments in full” that serve as the basis for release from criminal liability.
