Abstract

New copyright law was enacted on July 1, 1978 in Korea. In the same year, Korea joined the Universal Copyright Convent ion and Geneva Agreement to protect domestic as well as foreign copyrighted materials by law. Therefore, foreign copyrighted materials are no longer allowed to produce without consent s of author s. Development of printing technology made it possible to copy the original without much costs. This new development made it necessary to protect the right of author and people began to pay attentions to copyright law. Amid the increased attentions, Status of Ann was enacted in England in 1909. With the further development of technology, all the different kinds of materials overwhelmed the whole and the issues of copyright have come to attention across the national boundary. In the field of education, protection of copyright became one of major controversial issues. Under the tight budget constraint s, development of cheap and easy- handing copy machines lured teachers to copy the original illegally. Moreover, in case of videotapes, audiotape s, and computer softwares, it is very difficult to determine the boundary between violating the copyright and copying ma teria ls for fair use. In this study, many domestic as well as foreign case studies are presented to serve as a guideline for using copyrighted materials legally. Also, for the better under standing of copyright law, followings are suggested : First, public relations for the legal use of copyrighted materials should be enhanced. Workshops and inservice programs for teacher s and student s should be developed. Second, it should be well publicized that consent s of authors prevail the copyright law. Therefore, it is recommended to get the permissions of authers for legal use with less cost, if possible. Third, adopting of Blanket Licensing Scheme can be examined as asolution of copyright related disputes.
