Abstract

While a concept of transgender has recently been expanding, transgender people are known as the persons whose state of gender identity or gender expression is not matching their assigned sex. The petition in changing their legal identification such as recorded sex on birth certificate has been granted after medical treatment since the 1990s in Korea. The basis of granting their legal petition was initially on their sex chromosomes configuration, but both physical and psychological states have been considered when permitting the petition since 2006. In spite of the rapidly developing legal system related to sexual orientation, a number of legal issues for transgender people are still controversial. Most of the issues are related to protect their basic rights, and thus the author placed the emphasis on the necessity of protecting their humans rights in this article.
