КОДЕКС ЦИВІЛЬНОГО ЗАХИСТУ УКРАЇНИ – ОСНОВА ОРГАНІЗАЦІЇ ДЕРЖАВНОГО УПРАВЛІННЯ У СФЕРІ ЦИВІЛЬНОГО ЗАХИСТУ В СУЧАСНИХ УМОВАХ УКРАЇНСЬКОГО ДЕРЖАВОТВОРЕННЯ

Abstract

The Code of Civil Protection of Ukraine regulates relations related to protection of the population, territories, environment and property from emergencies, response to them, functioning of the unified state civil protection system, and defines the powers of state authorities, local authorities, as well as rights and obligations of citizens of Ukraine, foreigners and stateless persons, enterprises, institutions and organizations regardless of their form of ownership. It has the significant theoretical, in particular for the organization of state administration in the sphere of civil protection, and practical importance for ensuring functioning of the unified state system of civil protection, its functional and territorial subsystems and their sectors. However, being relevant nowadays, the Code of Civil Protection of Ukraine urgently needs substantial amendments to be made.The purpose of the article is to analyze the implementation of the Code of Civil Protection of Ukraine and normative legal documents, developed due to its requirements, to evaluate their practical implementation and relevance in the context of the unified state system of civil protection reforming, as well as to reason the need for amendments and additions to be made.The article also implements the task of analyzing the amendments made to the Law of Ukraine “On National Security of Ukraine” for the implementation of the Code of Civil Protection of Ukraine, their practical significance and relevance.The main conclusion of the article is the necessity of amendments and additions to be made to the Code of Civil Protection of Ukraine in order to bring it in line with modern requirements in the context of European integration of Ukraine and further decentralization of the power.As a final outcome of the article, specific proposals on amendments and additions to be made to the Code of Civil Protection of Ukraine have been made regarding management of the civil protection of Ukraine, formation and implementation of state policy in the sphere of civil protection, clarification of the powers between the subjects of civil protection, ensuring fire safety, insurance in the sphere of civil protection, etc.
