Abstract

The article deals with the problem of implementing migration policy by a modern state governed by the rule of law. The author analyzes approaches to understanding the category of «rule of law» and, highlighting the basic requirements for this model of political and legal organization of society, examines the specifics of its implementation of the function of controlling population migration. The difficulties faced by the modern state in implementing its migration policy, as well as demonstrating the limitations of the model of the rule of law in the issues under consideration, are determined.
