Abstract

When examining a prosecutor’s application for a pre-trial cooperation agreement, it is necessary to assess the current investigative situation that leads to its conclusion. The purpose of the study is to define the concept of an investigative situation as a prerequisite for concluding a pre-trial cooperation agreement, its significance for the prosecutor to make a tactically correct decision on the application. As a result of the conducted research, the author’s definition of the investigative situation at the conclusion of a pre-trial cooperation agreement is formulated, its significance is analyzed when the prosecutor makes a tactical decision based on the results of consideration of a petition for the conclusion of a pre-trial cooperation agreement.
