ТЕОРЕТИЧНІ АСПЕКТИ ТА ЕКОНОМІЧНА СУТНІСТЬ ПОНЯТТЯ ПРАВА ІНТЕЛЕКТУАЛЬНОЇ ВЛАСНОСТІ

Abstract

The article uses the concepts of and property law based on a critical analysis of existing interpretations, which chooses the author's vision of the conceptual foundations that form the essence of the definitions indicated by the category. Emphasis is placed on the fact that the generalization of existing theoretical approaches to the study of issues related to the formation and development of intellectual property rights, improving the categorical and conceptual apparatus and developing recommendations for improving the socio-economic conditions of society to form a long-term competitive advantages of the national economy is quite relevant. This issue acquires special significance in modern conditions of strengthening the protectionism of individual countries on the basis of globalization. As a result of research, provisions on a formation of the intellectual property rights protection system were further developed. A thorough analysis of methodological approaches of foreign and domestic scientists to the definition of certain elements of intellectual property is carried out in this article. The general principles of the concept formation of with an application of the historical-logical approach, and also components of a formation of the intellectual property rights protection system are allocated. In order to deepen the existing approaches to the study of these issues, the threats and opportunities created by the implementation of intellectual property rights protection system at all levels: local, international, global. The structural and logical scheme of intellectual property objects is given. The authors note that from the point of view of socio-economic relations of special interest are the issues of discussion and definition of intellectual property rights, their change of interpretations and opportunities over time, the relationship of intellectual property rights with changes in the economy and innovation system under the influence of technological innovations. Also of interest is a question of socio-political aspects of this phenomenon and ethical issues that may be raised. The authors improve the theoretical foundations and propose a generalization of the tools of the concept-category apparatus of intellectual property as a socio-economic institution.
