Abstract

ملخص الوسوسة القهریة وأثرها فی عقد النکاح توفیق بن علی بن أحمد الشریف أستاذ الفقه المقارن والقضاء المشارک بجامعة أم القرى D2004t@hotmail.com یتناول هذا البحث موضوع الوسوسة القهریة وأثرها فی عقد النکاح، وقد جاء هذا البحث فی ثلاثة مباحث: فی المبحث الأول: بینت التعریف بالأمراض النفسیة، وأقسامها، وفیه مطلبان: المطلب الأول: تعریف الأمراض النفسیة، والمطلب الثانی: أقسام الأمراض النفسیة. أما المبحث الثانی: فقد تناولت فیه التعریف بالوسوسة القهریة وأقسامها، وفیه مطلبان: المطلب الأول: تعریف الوسوسة، والمطلب الثانی: أقسام الوسوسة، وفی المبحث الثالث: بینت أثر الوسوسة فی عقد النکاح، وفیه أربعة مطالب: المطلب الأول: صور الوسوسة فی عقد النکاح، والمطلب الثانی: أثر الوسوسة فی عقد النکاح، والمطلب الثالث: هل یقاس الوسوسة على عیوب النکاح؟، والمطلب الرابع: هل یحق لأحد الزوجین فسخ النکاح عند ثبوت الوسوسة فی الطرف الآخر؟ وقد توصلت من خلال هذا البحث إلى أن مرض الوسواس یحدث بسبب اضطراب فی النواقل العصبیة فی المخ وتغیرات مرضیة أخرى، وأن مریض الوسواس القهری غیر مسؤول عن حدوث المرض ولا أسرته ولا من حوله، بل هی مسؤولیة مخه وفی أحیان کثیرة، ولا یحق لأحد الزوجین أن یفسخ عقد النکاح فی حال وجود أو علة یستحیل معها العشرة بین الزوجین، وأخیرا یتوجب على مریض الوسواس إخبار الطرف الآخر قبل عقد النکاح، ویثبت الخیار به للطرف الآخر فی حال عدم الإخبار به هو العیب المنفر الذی ینتفی معه مقصود النکاح من المودة والرحمة. الکلمات المفتاحیة : الوسوسة القهریة – أنواع الوسوسة- الأمراض النفسیة- الرضاع – النکاح – الطلاق – أثر الوسوسة – الوسوسة فی الفقه . The topic the third Ne : dealt with in which the definition of waswaas compulsions and its divisions, in which the two demands : first demand : the definition of Meticulousness , and the second requirement: Meticulousness sections , and in the third section : showed the impact Meticulousness in the marriage contract , and the four demands : First requirement : Photos Meticulousness in the marriage contract , and the second requirement : the impact Meticulousness in the marriage contract , and the third demand : Do Iqa Meticulousness disease Q defects Marriage ? And the fourth requirement : Is it right for one of the spouses to dissolve the marriage when the disease was proven in the other party ?
