Abstract

In this article, the author examines the problems of theory and practice caused by the need to determine the moment of emergence of the right of separate ownership of spouses in relation to real estate in the event of their concluding a marriage contract. The influence of the latter on the emergence of mutual rights and obligations of spouses is determined, the specifics of real estate as an object of their separate property are identified, the difficulties of law enforcement of rules on registration in the unified register of spouses’ rights to such property, determined by the influence of such a special basis as a marriage contract, are determined.
