Abstract

In order to determine the legal nature of the concept and essence of scientific and technological development, the categories «science», «technology», «scientific activity», «scientific and technical activity», «innovation activity», «technology transfer» are analyzed. Emphasis is placed on the fact that the concepts of «scientific and technological development» and «innovative development» have a complementary nature. Scientific and technological development is a complex mechanism that consists of a set of interconnected elements, closely interconnected by causation, and if you exclude at least one element, the whole complex mechanism will not work. A new term «scientific and technological activity» is proposed, the content of which would cover all components of scientific and technological development, in particular: scientific, scientific and technical, innovative activities, as well as technology transfer (as an element derived from the outlined activities). It is concluded that scientific and technological development as an object of administrative and legal support, on the one hand – is a progressive and continuous process of qualitative transformation of all spheres of public life through the use and application of theoretical and practical knowledge to solve specific socio-economic and environmental problems and ensuring the sustainable development of society as a whole; and on the other hand – the object of administrative and legal support of scientific and technological development are public relations in respect of which the state exerts a protective influence in the face of authorized authorities, arising, changing and ceasing in the fields of scientific, scientific and technical and innovative activities, technology transfer and intellectual property.
