Abstract

Religious and philosophical interpretation of the principles of sentencing according to the Ancient Indian dharmashastras The article analyzes the criminal law prescriptions of religious, ethical and philosophical treatises – dharmashastras, compiled in the period from the II century BC to the V century AD in Ancient India. The author identifies a number of principles of sentencing such as principle of class status, inevitability and individualization of punishment, principle of compliance with the severity of the imposed punishment and the severity of the committed crime. The scientist gives interpretation of the principles in the context of religious and philosophical ideas of ancient Indians.
