Abstract

The article is devoted to the formation of an actual scientific thought about the conceptual essence of the legal mechanism for the realization of the rights of persons with disabilities in the field of labor relations. Based on a critical analysis of the essence of the concepts of “legal mechanism”, as well as “realization of the rights of persons with disabilities in the field of labor relations”, the author formulates the definition of “legal mechanism for the realization of the rights of persons with disabilities in the field of labor relations”. The list of the main special features of the legal mechanism under study as a mechanism is established, which is characterized by the fact that it is: a multi-valued socio-legal phenomenon; conceptually subordinated to the doctrine of the welfare state; aims to create favorable conditions for the effective objectification of the goal of realizing the rights of persons with disabilities in labor relations; performs a set of tasks (implementation in practical reality of the standards of harmonious stability of labor relations, as well as the standards of the concept of decent work; implementation of measures, full and productive employment of persons with disabilities, etc.); covered by the state policy in relation to persons with disabilities; in its manifestation causes a specific socio-legal effect that affects society and the state.
