Доктринальне поняття об’єктів цивільних прав та їх система в умовах рекодифікації

Abstract

The article examines scientific approaches to the concept and legal nature of objects of civil rights, determines their place in the system of civil law, offers the author's definition of the object of civil rights, substantiates its constitutive features. The peculiarities of individual objects of civil rights are clarified, their common and distinguishing features are determined. The specifics of the legal regime of individual objects of civil rights is identified, the features of the civil turnover of individual objects of civil rights are defined. Methodological principles and criteria for building a system of civil rights objects in the conditions of recodification are outlined. Specific proposals for improving civil legislation in relation to the concept and system of objects of civil rights, the new version of Article 177 of the Civil Code of Ukraine "Objects of civil rights" were formulated.
