Abstract

Research Summary: The importance of the law appears in considering it a regulator and ruler of social ties that works on the survival and advancement of society by controlling relations between individuals and spreading the spirit of order and tranquility among them. In addition, the law plays a pivotal role in facing crises through a number of decisive measures that control the risks of the crisis. This was reflected in the face of the Corona crisis that swept the world recently and caused confusion in determining ways to deal with it at all levels, including the legal level; Where this crisis posed a real challenge to the extent of the effectiveness of legal texts in confronting them and analyzing their legal nature, and the extent to which this nature agrees with the criminal policy of the principles that govern criminalization and punishment in the face of the dangerous behaviors involved in it that constituted a threat to one of the basic human rights, which is the right to health. Studying the legal frameworks for the precautionary measures taken by Egypt and Saudi Arabia to confront this pandemic; Based on the policy of indirect criminalization, which is one of the most prominent axes of innovation in modern criminal legislation, as it is based on the principle of criminal legitimacy in its modern sense, which accompanies the policy of punitive development in the contemporary criminal system.
