ЩОДО ВИЗНАЧЕННЯ ПОНЯТТЯ «ПЕРСОНАЛ ДЕРЖАВНОЇ КРИМІНАЛЬНО-ВИКОНАВЧОЇ СЛУЖБИ УКРАЇНИ»

Abstract

The article is devoted to determining the scope and content of the concept of “personnel of the State Criminal-Executive Service of Ukraine” as a set of persons performing professional duties in all structural units of the relevant bodies. The ratio of basic terms, which are generalizing for determining the circle of employees of the criminal-executive (penitentiary) system, in particular “personnel of the State Criminal-Executive Service of Ukraine”, “personnel of bodies and institutions of execution of punishments”, “staff”, “administration” is analyzed. The differences between the concepts of “personnel of the State Criminal-Executive Service of Ukraine” and “personnel of bodies and institutions of execution of punishments” have been established and it has been determined that the latter definition has a narrower understanding. It is determined that the concept of “staff” is not synonymous with the category “personnel”, since it does not cover all the diversity of the personnel of the relevant body. On the basis of this, it was concluded that the personnel of the State Criminal-Executive Service of Ukraine should be understood as individuals of ordinary and superior personnel, specialists who do not have special titles, other employees working under employment contracts in bodies and institutions of execution of punishments, paramilitary formations, educational institutions, health care institutions, enterprises of penitentiary institutions, other enterprises, institutions and organizations created to ensure the fulfillment of the tasks of the State Criminal-Executive Service of Ukraine. According to the status and functions of the State Criminal-Executive Service of Ukraine established by law, the structure of the personnel of the relevant bodies and institutions is determined. The structure includes the following personnel groups: personnel of penitentiary authorities, personnel of penitentiary institutions, personnel of state institutions created to ensure the fulfillment of the tasks of the State Criminal-Executive Service of Ukraine, personnel of territorial (interregional) paramilitaries of the State Criminal-Executive Service of Ukraine, personnel of educational institutions, personnel of health care institutions, personnel of state enterprises of the State Criminal-Executive Service of Ukraine.
