Abstract

Based on the works of Professor N.M. Konin and other administrative scientists, the author justified the definition, which provides all the necessary at the present stage, signs of administrative coercion. The article examines the issues of theoretical definition of the concept of “administrative coercion”. The relevance of the article is due to the implementation in the Russian Federation of a risk-based approach to the organization of state control and supervision and the implementation of the mechanism of “regulatory guillotine”, which implies the optimization of these functions. As a result, the concept of “administrative coercion” also requires rethinking.
