Abstract

The purpose of this research was to define qualifying signs of corporeal rights. Qualifying signs are signs which are necessary and sufficient in order to attribute the property right to the category of corporeal rights. In order to fulfill this purpose, the following objectives have been set. First, the principles of legal regulation of property relations should be studied. Second, the relation between the principles of legal regulation of corporeal rights and the signs of corporeal rights needs to be explored. The article notes that the properties of corporeal rights have a different nature. The properties of corporeal rights can be divided into two groups. The first group includes the properties of corporeal rights which reflect the essence of legal relations. The second group includes the properties of corporeal rights which reflect the peculiarities of legal regulation of these relations. The article introduces the concepts of direct and indirect signs. The article analyzes the principles of legal regulation of property relations. The result of research are the list of indirect of signs of corporeal rights. Based on the analysis of the principles of property law was the conclusion about the need to clarify the list of principles of legal regulation. The results of this research can be used in the process of improvement of civil legislation.
