Новый закон о психиатрической помощи: каковы ожидания? Взгляд юриста и клинициста

Abstract

The article is devoted to the study of the currently emerging prospects for the creation of the concept of a new law on psychiatric care, the work on which is currently being actively conducted by the working group formed at the Public Chamber in the Russian Federation to improve the legal regulation of the protection of the rights of citizens with mental disorders in the Russian Federation. The authors present only individual proposals of the working group, which, in their opinion, need careful reflection, scientific analysis, justification not only from a medical point of view, but primarily from a legal, including organizational and methodological, since we are talking about a significant change in the foundations of the current psychiatric legislation. The authors note that the current Law of the Russian Federation No. 3185-1 dated 02.07.1992 “On psychiatric care and guarantees of citizens' rights in its provision” has been amended more than once, its conceptual ones have remained the same, although in line with the trends of improving legislation on healthcare should have changed. By scientific analysis of the provisions of the current Law of the Russian Federation dated 02.07.1992 No. 3185-1 “On psychiatric care and guarantees of citizens' rights in its provision” comparing its individual provisions with the proposals of the new concept of the law on the substance of the issues under discussion, the authors formulated their own proposals of medical and technical-legal orientation.
