Abstract
To provide basic material for helping nationals` oceanic leisure, the present situation of relevant regulations and those which are projected to be legislated in 2007 were examined and the following were concluded. First, present regulation regarding bathing beaches facility management include Ministry of Maritime Affairs and Fishery`s regulations and instructions, which are Guidelines for beach facility installation and management and Guidelines for beach water quality, and local guidelines, which are Regulations for organizing and managing 119 sea guards, and Regulations for management of beaches. Second, by pushing forward for legislation of Guidelines for beach facility and management, and with the fishing boat law and the water leisure safety law, a basis has been set for legally supporting oceanic leisure activities like sea swimming, sea fishing, and leisure in water. Third, Guideline for beach facility and management will require specifics for safety measures in designing and managing beaches, thereby setting a legal basis for managing safety issues which has been conducted by individual organizations without relevant protection by law, and contributing to organization of the safety system and collaboration between different organizations. Fourth, Guideline for beach facility and management will have clauses of penalties and fines, thereby contributing to improvement in management and systematic utilization of beaches. The Guideline for beach facility and management is not timely considering the number of people visiting the beaches and the influence they have on the local economy. There should be efforts from the personnel concerned, and preparations for following regulations such as enforcement laws and regulations so that this law could contribute essentially to oceanic leisure activities. To achieve this, reexaminations of current regulations that are relevant, knowledge of experts, field experiences from working-level personnel, and opinions of the local residents all should be considered.
