Abstract

جرائم التجارة الالکترونية ظاهرة عالمية وهي تشکل تهديدا خطيرا للأفراد بشکل شخصي وللمؤسسات وللدول، حيث إن أمنها الالکتروني أصبح في خطر؛ لذا لابد من وجود تشريعات؛ کي تحد من هذه الجرائم، وکذلک وجود آليه للکشف عن تلک الجرائم الخطيرة، وکيفية إثباتها؛ حيث إن عامل الخفاء فيها متوفر لدرجة کبيرة.لذا قسمت هذا البحث إلى مقدمة، وأربعة مباحث تناولت في المقدمة: أهمية الدراسة وأسباب اختارها، والمنهج المستخدم، وخطتها. والمبحث الأول تناول ماهية جرائم التجارة الإلکترونية وتناولت فيه تعريف مصطلحات البحث من کلمة جرائم وکلمة التجارة الإلکترونية، والمبحث الثاني تناولت فيه صور جرائم التجارة الإلکترونية، وتحدثت في هذا المبحث عن خصائص التجارة الإلکترونية بأنها عابرة للقرارات وصعوبة اثباتها، وأنها أقل عنفا في التنفيذ وتحتاج خصوصية للمجرم، ثم تناولت فيه صور هذه الجرائم وهي موضوع البحث وحصرت صور جرائم التجارة الإلکترونية في جرائم التوقيع الإلکتروني، جريمة السطو على بطاقة الائتمان، جريمة التهرب الضريبي في التجارة الإلکترونية، جريمة الغش التجاري في التجارة الإلکترونية، جريمة غسيل الأموال الالکترونية، جريمة الإعلانات الخادعة، والمبحث الثالث: وسائل إثبات جرائم التجارة الالکترونية، وختمت بالمبحث الرابع الذي تناول عن الحماية الفقهية والقانونية للحد من جرائم للتجارة الإلکترونية، وتناولت فيه التشريعات الغربية والعربية التي شرعت من أجل الحد من انتشار تلک الجرائم ثم ختمت البحث ببعض النتائج والتوصيات. E-commerce crimes are a global phenomenon and that they respect pose a serious threat to individuals personally and to institutions and countries, as their electronic security is at risk; So there must be legislation to limit these crimes as well as the existence of a mechanism to detect these serious crimes and how to prove them Since the invisibility factor in them is available to a large degree. Therefore, I divided this research into an introduction and four topics. In the introduction I dealt with the importance of the study, the reasons for choosing it, the method used and its plan. The first topic dealt with what e-commerce crimes are and I dealt with the definition of search terms from the word crimes and the word e-commerce. In the second I topic dealt with the images of e-commerce crimes and talked about the characteristics of e-commerce as transcending decisions and the difficulty of proving them and that it is less violent in implementation and needs privacy for the criminal Then I dealt with the images of these crimes which are the subject of the research and I limited the images of e-commerce crimes to the crimes of electronic signature, the crime of credit card burglary, the crime of tax evasion in e-commerce, the crime of commercial fraud in electronic commerce, the crime of electronic money laundering, the crime of deceptive advertising. In the third research I talked about means of proving electronic commerce crimes I concluded with the fourth topic that dealt with jurisprudential and legal protection to reduce e-commerce crimes, and dealt with Western and Arab legislations that were enacted in order to limit the spread of these crimes. Then I concluded the research with some findings and recommendations
