Abstract

תקציר בעברית: המאמר טוען שאת הדיבור ודמוקרטית אין להבין כתמצית של שתי מערכות ערכים נתונות ומתחרות, המוציאות זו את זו ושנגזר עלינו לחוות עימות קבוע ביניהן; אלא כהנחיה מעשית לאופן הבירור של שאלות ומחלוקות שבמדיניות ציבורית – המתודולוגיה של הזהות הישראלית. מדינה שמגדירה עצמה כמחויבת לחיבור של עולמות תרבותיים, ערכיים ואידיאולוגיים – ודמוקרטית – מקבלת על עצמה אילוץ רצוי בתהליך הבירור של כל מחלוקת ציבורית, כולל כזו שנוגעת למהות היהודית והדמוקרטית של המדינה: עליה לוודא קיומו של שיח ערני, ביקורתי ומכיל, המחויב למתן ביטוי ומענה לצרכים, להעדפות, לאמונות ולחששות של כל זרמי החברה הישראלית, בעודו ניזון מן העושר הערכי המתאפשר מן הדואליות החוקתית הישראלית ומהפלורליזם הרעיוני המגולם הן בדיבור יהודית והן בדיבור דמוקרטית. זו מתודולוגיה שאינה מוכנה לוותר על אף אחד מהקולות האותנטיים הנשמעים בשדות אלה, אפילו אם השמעתם מקשה על תהליך ההכרעה או מקוממת מי ממשתתפיו; ובה בעת היא אינה מוכנה לוותר לאף אחד מן המשתתפים בהליך קבלת ההחלטות, במובן זה שהיא תובעת מכל המעורבים להכיר ולהתחשב ביסודות הזהות של הצדדים הנוספים, כתנאי להכרעה לגיטימית בכל עניין ועניין. English Abstract: The essay argues that the phrase “Jewish and democratic” should be understood not as the essence of two static, mutually exclusive value systems, predetermined to coexist in ongoing conflict. Rather, it should be construed as a practical instruction for the deliberation and resolution of questions of public policy: it is the methodology of Israeli identity. A country that defines itself through a commitment to the joining of cultural, ethical, and ideological worlds—“Jewish and democratic”—accepts a welcome constraint on the process of deliberating any public dispute, including (but not limited to) those that pertain to the “Jewish” and “democratic” facets of its identity. It must foster a vibrant, critical, and inclusive public discourse, which is committed to the expression and recognition of the needs, preferences, beliefs, and concerns of all streams in Israeli society, and is informed by the richness of value enabled by Israel’s constitutional dualism and the conceptual pluralism embedded in it. This is a methodology that demands to hear any authentic voice in these fields, even if its expression encumbers the decision making process or irritates participants in it; and at the same time demands of all participants a recognition and consideration of the foundations of everyone’s identities as a condition for legitimate outcomes.
